The Law establishes the legal basis for the use of the radio frequency spectrum of Ukraine, determines the powers of the state in relation to the conditions for the use of the radio frequency spectrum of Ukraine, the rights, obligations and responsibilities of public authorities exercising control and regulation in this area, and individuals and legal entities using and / or intending to use the radio frequency spectrum of Ukraine.
Attention! This Law will be suspended on January 01, 2022, due to the entry into force of the new Law of Ukraine On Electronic Communications 1089-IX
Violation of the rules for operation and trade in radio-electronic devices and emitters of any type and its purpose, as well as the use of the radio frequency spectrum of Ukraine without a proper permit or license or in violation of the rules of the use of the radio frequency spectrum of Ukraine, entail the imposition of a fine on citizens from 20 to 50 tax-free minimum incomes citizens with or without seizure of the devices and on officials and private entrepreneurs from 50 to 100 tax-free minimum incomes of citizens with or without seizure of the devices.
The same actions committed repeatedly within a year after the imposition of an administrative penalty for one of the violations mentioned in the first part of this article, shall entail the imposition of a fine on citizens from 50 to 100 tax-free minimum incomes of citizens with seizure of the devices and on officials and private entrepreneurs from 100 to 300 non-taxable minimum incomes of citizens with or without seizure of the devices.
We would like to draw your attention to Paragraph 1 and Paragraph 2 of Article 25 of this law "Conditions for the use of radio-electronic devices and emitters in the territory of Ukraine"
1. A condition for the use of radio-electronic devices and emitters in the territory of Ukraine is documentary evidence of their compliance with technical regulations (the declaration of conformity).
2. Conformity of radio-electronic devices and emitters is confirmed in accordance with the Law of Ukraine "On technical regulations and conformity assessment" by duly accredited bodies authorized to carry out these activities, the list of which is approved by the National Commission for the State Regulation of Communications and Informatization (NCCIR).
