This Technical regulation establishes requirements to the devices for the purpose of placing of the equipment meeting the due level of electromagnetic compatibility in the market of Ukraine.
This Technical regulation is developed on the basis of the Directive 2014/30/EU of the European Parliament and Council of February 26, 2014 about harmonization of the legislation of state members on electromagnetic compatibility.
In our opinion, the following essential clauses are the most important:
2. This Technical regulation applies to any device or fixed unit.
3. This Technical regulation shall not apply to:
- 1) the devices covered by Technical regulations for radio equipment approved by Resolution of the Cabinet of Ministers of Ukraine No. 355 dated May 24, 2017 (Official Journal of Ukraine No. 45, 2017, Article 1396)
- 4) the equipment, which physical characteristics:
does not allow to deliver electromagnetic radiation or to lead to emergence of the electromagnetic radiation exceeding the level when radio, telecommunication and other equipment is operating as intended;
allow operating without inadmissible deterioration in characteristics in the presence of electromagnetic interference which usually appear when it is used as intended;
- 5. This Technical Regulation does not affect the application of legislation regulating equipment safety issues.
Regarding the placing in the market or putting equipment into operation, paragraph 7 of this document reads as follows:
The equipment can be placed in the market and/or put into operation only if it complies with the requirements of these Technical Regulations, provided that it is correctly installed, maintained and used for its intended purpose.
Another important clause to pay attention to is
40. The declaration of conformity declares that meeting the essential requirements specified in Appendix 1 has been proven.
That is, you need a document confirming the passage of laboratory tests in any of the certified laboratories on the territory of Ukraine.
