Many have heard about the abolition of mandatory certification and the annulment of the so-called list of products subject to mandatory certification.
So why, after the adoption of the abolition of mandatory certification, an increasing number of goods, and especially equipment and radio electronics, require certificate of conformity (type examination certificate) ?
We will try to shed light on this issue in this article.
Let's start with the fact that the abolition of mandatory certification in Ukraine took place in 2018, the reason for this was the loss of force from 01/01/2018 Decree of the Cabinet of Ministers of Ukraine dated 10.05.93 N 46-93 "On Standardization and Certification", The State Certification System ceased to exist, that is, the UkrSEPRO system ceased to exist. This, in turn, led to the abolition of a number of legislative acts, including list, a list of products subject to mandatory certification, which many people unsuccessfully try to find.
Taking into account all of the above, we can conclude that in Ukraine only the concept of "voluntary certification" remains, and the concept of "mandatory certification" is a thing of the past.
But is it really so?
It's not as simple as it might seem at first glance. First, let's figure out why this was done.
The wording "cancellation of mandatory certification" meant only the abolition of a number of national standards for further adoption as the basis of the European standardization system.
In simple terms, the national system of standards has been abolished, but the European system of standards has been adopted.
The basis for this was the new Law of Ukraine "On Technical Regulations and Conformity Assessment" VVR, 2015, No. 14, art.96 according to which all manufactured or imported products into the territory of Ukraine must comply with certain technical regulations.
Thus, if earlier products in Ukraine were more likely to be declared than certified, now, according to the law, it is necessary to undergo certification.
We discussed the difference between these two concepts in the article the difference between a certificate and a declaration
On the basis of the aforementioned law, as already written, all manufactured or imported products into the territory of Ukraine must comply with technical regulations.
How do you know if your products are subject to any technical regulations or not. The most correct way would be to consult with a certification body or a competent company such as Unus Finis, or independent study of all legislative acts related to your products.
However, to simplify the study of the material, we recommend that you read our article list of goods subject to mandatory certification.
Summing up the above, it is safe to say that most goods now need certification and obtaining of the conformity certificate (type examination certificate). As for electronics, radio electronics, engineering and radio engineering, as well as instruments and devices that include any data transmission module such as GSM 900/1800 and / or CDMA800 / CDMA2000 (for voice transmission), protocols 1X EV-DO, LTE, LTE+, UMTS, HSDPA, HSDPA+, GPRS, EDGE, 5Ge,5G, 5G+, ZigBee and Thread, Bluetooth Mesh, Wi-Fi, NFC, M-Bus and RFID, these devices are subject to mandatory assessment of compliance with technical regulations i.e. certification.
Otherwise, the import and sale of these products on the territory of Ukraine is illegal.
