In accordance with Article 1, Article 14, Article 25, Article 26, Article 29 and Article 291 of the Law of Ukraine "On the radio frequency spectrum of Ukraine" ,(Attention! This Law will be suspended on January 01, 2022, due to the entry into force of the new Law of Ukraine On Electronic Communications 1089-IX ) the National Commission for the State Regulation of Communications and Informatization (NCCIR), made the following decision:
- To approve the Procedure for import and trading in radio-electronic devices and emitters in Ukraine, which is attached.
- To approve Amendments to some decisions of the National Commission for Communications Regulation of Ukraine (NCCR), which are attached.
To recognize as invalid the following decisions of the NCCR:
- No. 1338 dated February 5, 2009 "On approval of the regulation on the granting of permits for the importation of radio-electronic means and emitting devices from abroad to Ukraine," registered with the Ministry of Justice of Ukraine on March 17, 2009 (No. 242/16258);
- No. 1773 dated December 3, 2009 "On approval of the amendments to the regulation on the granting of permits for the import of radio-electronic means and emitting devices from abroad to Ukraine," registered with the Ministry of Justice of Ukraine on January 11, 2010 (No. 2/17297).
- The Department of Licensing shall submit this decision for state registration to the Ministry of Justice of Ukraine in the prescribed manner.
- This decision shall enter into force 120 days after the date of its official publication.
One of the main points of the procedure is Paragraph 1 of the general provisions, which is the basis for understanding the need to assess compliance with technical regulations on radio equipment.
This Procedure establishes the procedure for Import and Trading in Radio-Electronic Devices and Emitters in Ukraine, including products, which include radio-electronic units (emitters), for their free movement in Ukraine.
Any product (products) that, according to their characteristics, are assigned for the emission and / or adsorption of radio waves, or which includes the devices intended for this (the delivery set), is considered as a radio-electronic device (emitter). The following radio-electronic units in products can be found: Bluetooth, WiFi (or 802.11хх, where хх are letters of the Latin alphabet, or their combination), GSM, 3G (or CDMA, UMTS, WCDMA, etc), 4G (LTE, LTE-U, etc), RFID (NFC), Wireless, Radio Frequency (RF, RF Transmitter), Transciever.

Based on this document, upon receipt of the Certificate of Expertise, in one of the annexes it must be necessarily indicated that:
- The equipment does not belong to the types of radio equipment that are subject to the requirements of Clause 10 of the Technical Regulations on Radio Equipment (types of radio equipment that have the lowest level of compliance with the essential requirements of the Technical Regulations).
- The approved type of product is imported from abroad and traded in Ukraine in accordance with NCCR Decision No. 78 dated February 13, 2018.
