Mandatory certification in Ukraine is a documentary confirmation that the product complies with the standards and compliance systems established by Ukrainian legislation.

The concept of “mandatory certification” is used when, without documentary confirmation of the quality of a product or device, it cannot be imported into the territory of Ukraine, or a certificate of conformity and testing is required to sell this type of product.

The goods for which the concept of "mandatory certification" is applied are electronics, radio-electronic devices, emitting devices, radio equipment, means and devices for receiving and transmitting data, communications equipment, radio engineering and radio-electronic products and much more, that is, all devices in the which includes at least GSM, UMTS, LTE, CDMA, TETRA, DECT, WiFi, ZigBee, Bluetooth, WiMAX, NFC and RFID or M-Bus, M-GSM.

Mandatory certification covers all devices covered by of the Technical Regulations of Radio Equipment of May 24, 2017 No. 355 and Technical regulation on electromagnetic compatibility of equipment, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 16 December 2015 . No. 1077 (Official Gazette of Ukraine, 2016, No. 2, art. 72), Technical regulation of low-voltage electrical equipment, approved by the Decree of the Cabinet of Ministers of Ukraine dated December 16, 2015 No. 1067 (Official Gazette of Ukraine, 2015, No. 102 st. 3526).

Thus, almost all radio-electronic devices are subject to mandatory certification.

Without an assessment of compliance with technical regulations (certification), this type of product is prohibited for distribution and import on the territory of Ukraine.

"Voluntary certification" refers to devices that do not fall under the above technical regulations and do not violate the current legislation, but nevertheless must have a certificate of conformity in the accompanying documentation for their implementation on the territory of Ukraine. But certification of such devices is not mandatory and is carried out voluntarily at the discretion of the supplier or manufacturer.

Certificate of Conformity (compliance with technical regulations) is a confirmation that the product has been tested in an accredited certification center, a protocol has been issued for each type of test and this device complies with all standards and systems compliance.

Since 2018, the concept of "mandatory certification" and "list of products subject to mandatory certification" has been replaced by "mandatory compliance with technical regulations", and the basis for this was the adoption of Law of Ukraine "On Technical Regulations and Conformity Assessment"

To date, there is no specific list of devices subject to mandatory certification, however, according to the new adopted laws, it turns out that almost all goods are subject to assessment of compliance with technical regulations.

Thus, the manufacturer or importer needs to make Declaration of conformity indicating all technical regulations and test reports. The source of this information, as well as the document certifying the eligibility of the specified information, is the Certificate of Conformity, that is, the Declaration is drawn up on the basis of the Certificate.

Mandatory Certification has been abolished, but in Ukraine there is a mandatory compliance with the Technical Regulations.

The state reserves the right to require mandatory confirmation of the compliance of certain types of products with state standards and technical regulations. These are products, the manufacture of which with violations of the relevant requirements entails a danger to human health and life.

Since 2018, it has become mandatory to assess compliance with the requirements of technical regulations it has become an integral part of European practice. If a manufactured or imported product falls under a certain technical regulation, its manufacturer or importer is obliged to provide evidence that the product complies with the Technical Regulations, that is, provide a certificate of conformity and test reports , on the basis of which the declaration of conformity and other documents will be drawn up. Without it, the use, exploitation and distribution of such products on the market is prohibited. Compliance with the requirements for the implementation of the law is monitored by the relevant authorities (Ukrchastotnadzor, customs authorities and some others).
