For example, if the software of the tested sample does not have a menu item (or program) that includes an NFC module, then its “physical” presence on the board can be explained by the design features of the device or the operation of the NFC module itself (depending on the specific device). Let's take another example. In the case when it was possible to argue the blocking of some functions in the tested samples by means of software and obtain a Certificate of Conformity (Type Examination Certificate), the accompanying documents will contain certification agreement.
One of the points of which are the obligations of the customer, namely:
The customer undertakes to agree in advance with Unus Finis changes in the design (composition) of products, manufacturing technology, test and control methods, acceptance rules that may affect product performance confirmed during conformity assessment .
Inform Unus Finis of all product modifications that may affect the compliance of the radio equipment with the essential requirements of the Technical Regulations or the validity conditions of the specified certificate. Such modifications require additional type examination of the radio equipment and its approval in the form of a supplement to the original type-examination certificate.
Thus, if the customer, after receiving the type examination certificate, unlocks previously disabled functions by modifying or updating the software without additional testing of the device, he will violate certification agreement and a number of laws including Law of Ukraine "On Protection of Consumer Rights". The functions of compliance with the certification agreement are assigned to a number of regulatory bodies, including Market Surveillance.
